Applicants understand that Producer may require Series contestants to alter their act in Producer’s sole and absolute discretion. Applicants understand that Producer may, in Producer’s sole and absolute discretion, require any Series contestant to perform with or to music, recordings and/or materials that are assigned by Producer, and that such assigned music, recordings and/or materials may be in lieu of material the contestant regularly performs or prefers to perform. Thus, if selected, contestants should expect that all music they use in their acts in the Series will be assigned by Producer either directly or from a list of pre-approved choices selected by Producer, in Producer’s sole and absolute discretion, and that the contestant will likely not have a choice in music selection for their participation in the Series, beyond said list of pre-approved choices which Producer, from time to time, designates in its sole and absolute discretion.
